Jason Haney is an economist with over ten years of experience providing economic and statistical analysis in merger reviews and investigations, antitrust and competition, consumer fraud and product liability, and labor and employment matters. Mr. Haney supports clients and academic and industry experts in all phases of commercial litigation and regulatory investigations. His industry experience includes automotive and related industries, entertainment, food and beverages, oil and gas, technology, and telecommunications.

Merger reviews and investigations

On behalf of U.S. and international government agencies and merging parties, Mr. Haney has consulted on numerous high-profile merger reviews. Representative cases include his work on behalf of the merging parties during the litigation of T-Mobile/Sprint, and on behalf of the FTC in In the Matter of Aveanna Healthcare LLC and Maxim Healthcare Services. Mr. Haney has also consulted on early-stage mergers and led teams in support of agency clearance.

Antitrust and competition litigation

Mr. Haney has analyzed liability and damages issues in a range of competition-related matters. These have included allegations related to horizontal and vertical conduct, price fixing, exclusionary practices, monopolization, and monopsony. In FTC v. Qualcomm, Mr. Haney supported analysis and expert testimony related to shortcomings in plaintiff’s theory of harm and the presence of procompetitive justifications for the at-issue business practices.

Consumer fraud and product liability

Mr. Haney works on matters alleging product misrepresentation, product defects, and false and deceptive advertising. He has expertise in damages analysis using advanced methods such as conjoint analysis and hedonic regression. Mr. Haney has also designed, analyzed, and rebutted consumer surveys.

Labor and employment

Mr. Haney has consulted on high-profile labor matters involving alleged discrimination and issues related to employee/independent contractor status. Representative matters include Heldt et al. v. Tata Consultancy Services Ltd., a class action involving alleged discrimination on the basis of race and national origin.
