Gabriela Antonie provides economic and financial analysis in litigation involving antitrust and competition issues, mergers, and financial institutions. Applying her expertise in empirical methods and causal analysis, Dr. Antonie assesses impact, market definition and market power in antitrust, damages, and merger review matters. She has extensive experience conducting statistical analyses of proprietary big data. Dr. Antonie works with attorneys across all phases of litigation and government and regulatory investigations and supports experts through discovery and trial. Her industry expertise includes e-commerce, healthcare, life sciences, retail, and technology.
Dr. Antonie is vice chair of the Insurance and Financial Services Committee of the Section of Antitrust Law of the American Bar Association (ABA). She previously served as vice chair of the Section’s Economics Committee. Dr. Antonie co-organizes the Section’s Economics Ambassador Program, which is designed for recent graduates of economics programs interested in careers in antitrust or consumer protection. In addition, she regularly presents at the ABA on various antitrust topics.
Antitrust and competition
Dr. Antonie analyzes class certification, liability, and damages in antitrust and competition matters alleging monopolization and anticompetitive conduct. Her work includes:
- Analyzing horizontal restraints and abuse of market power in e-commerce
- Assessing alleged foreclosure and estimating damages in pharmaceutical markets
- Evaluating foreclosure claims in the context of the 340B Drug Pricing Program
- Analyzing foreclosure in the mortgage servicing industry
- Evaluating claims of tying and bundling in Sidibe et al. v. Sutter Health
Merger reviews and investigations
Dr. Antonie has consulted on multiple merger investigations, both on behalf of regulatory agencies and merging parties. In these contexts, she has managed and conducted analyses of market definition, competitive effects, and potential mitigating factors associated with proposed mergers such as Aetna/Humana, FTC v. Wilhelmsen et al., T-Mobile/Sprint, and Commercial Metals Company’s Acquisition of Certain Assets from Gerdau S.A.
Financial institutions
Dr. Antonie analyzes allegations of market manipulation in over-the-counter (OTC) markets including:
- Evaluating allegations of collusion and issues of class certification in the variable rate demand obligation market
- Evaluating claims of market manipulation in the bond market
Other litigation
Dr. Antonie evaluated the proposed theory of harm in a class action involving tuition payments to higher education institutions during the COVID-19 pandemic. She has also assessed liability and abatement issues in pharmaceutical matters.
