Elisa Olivieri coheads the labor and discrimination practice at Cornerstone Research. Dr. Olivieri specializes in labor economics and antitrust. She has expertise in matters involving race, gender, and age discrimination claims in hiring, promotions, and pay. She also analyzes competition issues in labor markets, including the effects that proposed mergers may have on workers.
Dr. Olivieri has extensive experience leading economic analysis in antitrust matters more broadly, including class certification, liability, and damages analyses in cases alleging monopolization and exclusionary conduct. In addition, she analyzes a range of merger-related issues, including market definition, competitive effects, and potential mitigating factors associated with mergers.
Antitrust and competition
Dr. Olivieri analyzes class certification, liability, and damages in antitrust and competition matters. Her experience includes:
- Assessing competition issues in labor markets
- Analyzing alleged exclusionary behavior in the internet search market
- Evaluating alleged quantity restrictions in an alleged conspiracy to raise prices of raw milk and processed milk products
- Evaluating merits claims in Fresenius Kabi USA v. Par Sterile Products LLC et al., a matter involving allegedly anticompetitive exclusive-supply arrangements for a pharmaceutical ingredient
- Leading teams to conduct analyses of market definition, competitive effects, and potential mitigating factors associated with proposed mergers in FTC v. Wilhelmsen et al. and the Department of Justice’s (DOJ)’s investigation of Aetna/Humana.
Labor, discrimination, and employment
Dr. Olivieri addresses class certification, damages, hiring, compensation, and promotion issues in high-profile labor economics matters. Representative experience includes:
- Analyzing labor market definition and the competitive effects that proposed mergers may have on workers
- Providing economic and statistical support from the discovery phase through trial in Students for Fair Admissions Inc. v. President and Fellows of Harvard College et al.
- Consulting with educational institutions to model their admissions processes and assess the role of race and legacy status in admissions
- Assessing alleged algorithmic racial bias in online advertising
- Analyzing alleged gender discrimination in pay and promotions at large employers
- Analyzing alleged racial discrimination in pay at a large university

Dr. Olivieri is involved with the firm’s pro bono initiatives. She has worked on a veterans advocacy matter involving damages associated with lost wages and a matter analyzing racial bias in the placement of police roadblocks.
