Avi Schiff consults on a variety of economic and financial matters, including those involving market manipulation claims, investment management, antitrust, and private equity and venture capital. Dr. Schiff leads case teams addressing class certification, merits, and damages issues and supports clients and experts through all phases of litigation including deposition and trial.

Market manipulation and investment management

Dr. Schiff has experience assessing allegations of market manipulation and improper trading in commodities and financial markets in regulatory investigations and class action lawsuits, including claims involving the Commodity Exchange Act (CEA).

He also analyzes a range of Employment Retirement Income Security Act (ERISA) and related investment issues, including matters alleging fiduciary breaches in connection with plan fees and investment choices, the use of alternative investments in defined contribution plans, and general plan administration.

Antitrust

Dr. Schiff has worked on antitrust matters alleging monopoly and monopsony and has supported experts rebutting claims of collusion and quantity suppression. In these contexts, Dr. Schiff has analyzed issues related to vertical integration, contracting, barriers to entry, and information-sharing among competitors.

Private equity and venture capital

Dr. Schiff has experience in private equity (PE) and venture capital (VC) matters. He has used option pricing models to conduct valuations of VC-backed firms. In PE-related matters, he has analyzed damages stemming from breach of contract claims.
