Cornerstone Research’s Expert Forum in London featured leading speakers offering ‘Frontline Perspectives on Recent Developments in Competition Litigation, AI and Mergers.’

The Forum, held on 20 November 2024, brought together leading experts to discuss the evolving competition litigation landscape, with an emphasis on the importance of economic evidence and innovative theories of harm.

Liam Colley, who heads Cornerstone Research’s European competition practice, opened the event, highlighting the dual themes of economic thinking and novelty that are permeating discussions in this space. The forum included panels addressing critical topics such as the impact of artificial intelligence (AI) on regulatory approaches and the exploration of behavioural remedies in merger assessments.

Speakers discussed:

  • Emerging novel theories of harm, which have diversified the types of experts providing evidence; in addition to traditional competition economists, behavioural economists, valuation experts and survey specialists now play key roles
  • The intrinsic novelty of AI and whether the matters involving AI require new ways of thinking about regulation
  • Explanations of why regulatory agencies are reticent to accept behavioural remedies, including concerns that such remedies may not adequately address competition issues
  • Complexities of consumer behaviour and decision-making, which often involve conflicting theories
