Carlyn Irwin of Cornerstone Research will speak on a panel titled “What’s New with Trade Secret Damages and Apportionment” on day one of this two-day conference.
The AIPLA Trade Secret Summit is the leading trade secret conference in the United States, with speakers from private practice, in-house counsel, government, and academia.
Discussion topics will include:
- An observed trend in the need for plaintiff to enable the jury to apportion damages
- The importance of apportioning damages when plaintiff asserts more than one trade secret
- The need for plaintiff to consider apportionment among trade secrets legitimately held by the defendant versus those alleged to be misappropriated
