The 2023 Merger Guidelines signal a stricter approach to mergers than in past eras of antitrust enforcement. The Guidelines marks a shift away from the presumption that mergers regularly improve competitive dynamics in a market by accomplishing procompetitive benefits. The belief that large mergers consistently lead to significant efficiencies is being challenged.
Panelists will explore whether the evidence supports a more stringent or lenient approach to merger review.
