On behalf of several large corporate purchasers of vitamins, counsel retained Cornerstone Research to address both liability and damages issues.

In 1999, the world’s major vitamin producers pled guilty in the United States to conspiring to fix vitamin prices from 1990 to 1999. The producers, including F. Hoffmann- LaRoche Ltd., Rhône-Poulenc S.A., BASF AG, Eisai Co., Ltd., Takeda Chemical Industries, Ltd., Lonza AG, Daiichi Pharmaceutical Co., Ltd., and Degussa AG, paid fines of over $870 million in the United States and over $1.6 billion worldwide. Civil suits followed the criminal investigation.

The case settled on favorable terms for our clients.

We supported Professor Kenneth Elzinga of the University of Virginia on liability and Dr. Michael Keeley of Cornerstone Research on damages. Dr. Keeley based his damages estimates on an econometric analysis of several large data sets of vitamin prices and quantities. The case settled on favorable terms for our clients.
