Dencom, a distributor of Mitel private branch exchange (PBX) telecommunications equipment, alleged that Mitel had engaged in predatory pricing and other anticompetitive business practices. Dr. Michael Keeley  of Cornerstone Research worked with counsel for Mitel to study the market for the sales and service of PBX equipment and to address plaintiff’s allegations. In two declarations filed in support of summary judgment, Dr. Keeley concluded that Mitel did not have market power in any relevant market, that its business practices were procompetitive, and that Mitel had no incentive to reduce competition for the sales and service of its PBX equipment. The case settled.
