Dan Garrett specializes in applying economic analyses to misrepresentation and breach of contract matters. He has worked with clients in the telecommunications, technology, pharmaceutical, oil, financial institutions, and consumer products industries.
Class certification
Dr. Garrett has addressed economic issues relating to class certification in antitrust, securities, and misrepresentation cases. In securities, the teams’ analytical focus has been on market efficiency, for example, in the hearing testimony he presented in Nancy George et al. v. China Automotive Systems Inc. et al. In misrepresentation cases, he has led teams that have assessed exposure, reliance, and causality.
General damages
He has addressed general damages in testimony during several states’ hearings between major tobacco companies and the states’ attorneys general regarding the Master Settlement Agreement. He has addressed lost profits in contract disputes in technology, franchising, and entertainment, among other industries. His work related to general damages has been in state court, federal court, and international arbitration.
Securities
Dr. Garrett has conducted and led numerous event study analyses for market efficiency, materiality, price inflation, loss causation, and damages in disclosure cases. In addition, he has assisted clients with matters related to Securities and Exchange Commission investigations and on class actions involving allegations of mutual fund market timing. Additionally, he has submitted declarations to the court for Employee Retirement Income Security Act (ERISA) cases such as In re Computer Sciences Corporation ERISA Litigation.
Dr. Garrett has given presentations at events organized by the Federal Trade Commission, the American Economic Association, the New York State Bar Association, the Association for Financial Counseling and Planning Education, the Center for Pension and Retirement Research, and the Western Economic Association. He coauthored “Economics of Antitrust: An Economic Analysis of Resale Price Maintenance,” published in Global Competition Review’s special report, The Antitrust Review of the Americas.
Dr. Garrett joined Cornerstone Research in 1996 after completing his doctoral work in public economics, industrial organization, and applied microeconomics.
