Lucia Yanguas provides economic and statistical analysis in matters involving product misrepresentation and antitrust allegations. Dr. Yanguas applies sophisticated analytical tools, including surveys, content analysis, and econometric models, to address complex class certification, liability, and damages issues. She supports clients and experts in all phases of commercial litigation arising in a range of industries, with a focus on healthcare and life sciences.
Consumer fraud and product liability
Dr. Yanguas consults on litigation alleging false marketing and product misrepresentation, manipulative user interface, and data privacy violations. Her industry experience in these matters includes consumer electronics, cosmetics, credit cards, online advertising, and pharmaceutical products.
In consumer class actions, Dr. Yanguas has designed consumer and professional surveys to assess materiality, reliance, exposure, and heterogeneity. In IntegrityMessageBoards.com v. Facebook Inc., she supported a marketing expert who conducted a survey of Facebook advertisers to identify the sources of information they rely on and the factors that influence their decision to advertise on Facebook. The court cited the expert’s findings in denying class certification.
In addition, Dr. Yanguas has analyzed social media posts and public press articles to assess exposure to and reliance on alleged misrepresentations.
Antitrust and competition
Dr. Yanguas has analyzed allegations of anticompetitive delay of generic entry and reverse payments in the pharmaceutical industry, including in In re Novartis and Par Antitrust Litigation. She has also evaluated antitrust allegations involving monopolization and exclusionary practices in the healthcare industry.
Healthcare and life sciences
Dr. Yanguas consults on matters alleging consumer fraud, product liability, and antitrust in the pharmaceutical and healthcare industries. She has also supported industry experts on issues related to pharmacy delivery practices, hospital balance-billing practices, the drug development process, and electronic health records.
Pro bono
Dr. Yanguas is involved with Cornerstone Research’s pro bono initiatives. She contributed to the economic analyses in the American Bar Association’s (ABA’s) Commission on Hispanic Legal Rights & Responsibilities decennial report, “Latinos in the United States: Overcoming Legal Obstacles, Engaging in Civic Life.”
Dr. Yanguas has published research in the Journal of Urban Economics, the Journal of Economic Behavior and Organization, and the Economics of Education Review. She has also contributed to an article published by Law360 on the assessment of health data privacy damages during a pandemic.
