Elisa Mariscal will speak on a panel titled “New Theories of Behavioural Harm: No Poach, AI, Product Denigration, Purchasing Cartels” at this conference in Brussels.

Authorities in the European Union (EU), the United States and elsewhere are actively pursuing new theories of harm in competition law cases.  These novel approaches are evident in digital ecosystem cases, the pharmaceutical sector, cases involving sustainability considerations, labour market-related matters, and information sharing, among others. The panel will discuss new trends and theories of harm in the non-merger context.

Key topics will include:

  • Sustainability: The Competition and Markets Authority’s (CMA’s) guidance and EU directives aim to promote green initiatives
  • No-poaching agreements: The U.S. Department of Justice is pursuing more cases related to these agreements
  • Artificial Intelligence (AI) Regulation: Despite jurisdictional differences, global convergence is emerging
  • Product disparagement: Articles 101 and 102 address this practice as an abuse of dominance
